LEGAL TERMS AND CONDITIONS FOR PARTICIPATION IN THE GIVEAWAY

“2 NIGHTS OF DISCONNECTION FOR YOU AND SOMEONE OF YOUR CHOICE”

1. Identification of the Organiser

FRESHLY COSMETICS, S.L. (hereinafter, “FRESHLY”), with registered address at Calle Nicaragua 36, 43204 Reus (Tarragona) and tax ID (C.I.F.) no. B-55666143, organises the giveaway called “2 nights of disconnection for you and someone of your choice” (hereinafter, the “GIVEAWAY”), which shall be governed by the following Legal Terms and Conditions (hereinafter, the “Terms”).

2. Duration and territorial scope of the GIVEAWAY

The GIVEAWAY will start at 10:00 a.m. on 6 November 2026 and end at 9:00 a.m. on 10 November 2026, both dates inclusive and in mainland Spain time (hereinafter, the “Giveaway Period”). Participation will take place through the website https://www.freshlycosmetics.com/ca/lp-giveaway-freshly-x-masqi. The GIVEAWAY is open to participants resident in Spain.

3. Eligibility

All persons of legal age who are resident in Spain may participate in the GIVEAWAY. Each person may enter only once.

Employees of FRESHLY and, where applicable, of the companies involved in running the GIVEAWAY, as well as their immediate family members up to the second degree of consanguinity or affinity, may not participate.

Should any person excluded from participation for failing to meet the requirements of these Terms be drawn as a winner, or should the data provided in order to participate be invalid, their entry will be deemed void and will be automatically excluded.

4. Free of charge

Participation in the GIVEAWAY is free of charge.

5. Validity of participation in the GIVEAWAY

For an entry to be valid, the participant must follow the steps indicated on the GIVEAWAY landing page (https://www.freshlycosmetics.com/ca/lp-giveaway-freshly-x-masqi) and expressly accept FRESHLY’s data protection and privacy policy.

Participants may also enter through the links provided on FRESHLY’s official social media accounts (https://www.instagram.com/freshlycosmetics_es/).

Fraudulent entries will be disqualified from the GIVEAWAY outright.

Participation means that the participant has read and expressly and unreservedly accepted these Terms.

All non-winning participants will receive a thank-you email from FRESHLY. Only for those who have ticked the consent box to receive commercial communications, this email may include a coupon or temporary discount.

This GIVEAWAY is not sponsored, endorsed or administered by, or associated with, Instagram or Meta.

6. Prize

The prize consists of:

2 nights’ accommodation for two people (suite or superior double room).

2 days of full board for two people (gourmet organic menus made with organic products).

4 wellness activities per person (yoga, meditation…).

1 anti-stress massage.

The prize will be won by one person, who may enjoy it together with a companion of their choice, i.e. for a total of two (2) people.

The stay may be enjoyed on any day of the week, subject to the establishment’s availability, within 1 year from the notification of the prize. The prize is valued, as a whole, at €1,400. The prize is personal and non-transferable and may not be exchanged for cash.

The prize does not include:

Travel to the establishment’s location, which will be at the winner’s expense. FRESHLY does not cover such travel.

Any additional expenses, consumption or services not expressly stated in this clause.

FRESHLY will be responsible for providing the prize. Once the winner’s identity has been confirmed, FRESHLY will share their name and the necessary details with Masqi so that they are identified as the winner of the GIVEAWAY. To enjoy the prize, the winner must make the booking by contacting Masqi’s Reception directly, stating that they are the winner of the GIVEAWAY “2 nights of disconnection for you and someone of your choice” by Freshly Cosmetics.

The winner will not have to pay any amount for the items included in the prize. Any costs not included will be paid directly at the establishment.

7. Selection of the winner

Among all valid entries received during the Giveaway Period, a draw will be held for one prize consisting of two (2) nights of disconnection for you and someone of your choice. There will be a total of 1 winner and 2 reserve winners.

8. Notification of the winner

On Tuesday 10 November 2026, FRESHLY will announce the winner and notify them by email.

The winner will have FIVE (5) calendar days from that notification to accept the prize, which they must confirm by replying to that communication.

If the winner does not reply within that period, fails to comply with these Terms or rejects the prize, they will be disqualified and the prize will be awarded to the next person selected under the procedure set out in these Terms, in order of reserve.

Given that the prize consists of services provided by a partner establishment, FRESHLY reserves the right to update the date on which the prize is enjoyed whenever there is a justified reason.

9. Intellectual property and use of the winner’s name and image

Acceptance of these Terms entails the winner’s express consent to the use and dissemination of their first name and surname on FRESHLY’s website and social media, in connection with any promotional activity related to the GIVEAWAY, without such use entitling them to any remuneration or benefit, other than the prize won under these Terms.

10. Data protection

The data controller for participants’ personal data is FRESHLY COSMETICS, S.L. The data requested from participants and, where applicable, from the winner are necessary to manage their participation in the GIVEAWAY and, where relevant, to notify and award the prize, deliver it and thank them for participating.

In the case of the winner, their identification data will be shared with Masqi for the sole purpose of managing the booking and enjoyment of the prize.

Once the GIVEAWAY has ended, FRESHLY will only retain the data of those participants who, at the time of participating, gave their express consent, by ticking the box provided for that purpose, to receive newsletters and communications with commercial information, featured content, useful tips and promotions. The data of all other participants will be deleted from FRESHLY’s systems once the GIVEAWAY has ended, without prejudice to the possibility of retaining it, with its processing restricted, for the establishment, exercise or defence of legal claims, under the terms provided by applicable law.

Participants who have consented to receive such newsletters and communications may request that they stop under the terms of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and may withdraw their consent at any time by sending an email to [email protected] or by unsubscribing directly through the unsubscribe link at the foot of the newsletters.

Personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (GDPR), Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights, and FRESHLY’s Privacy Policy.

Participants may exercise their rights of access, rectification, erasure, restriction of processing, portability, objection and not to be subject to automated individual decision-making, including profiling, by sending an email to [email protected], and may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es). The Privacy and Data Protection Policy can be consulted at https://www.freshlycosmetics.com/es/politica-privacidad.

11. Reservations and limitations

FRESHLY is exempt from all liability in the event of a malfunction of electronic communication networks that prevents the normal running of the GIVEAWAY for reasons beyond its control and, in particular, due to external acts of bad faith.

Any abusive or fraudulent use of the participation forms or systems will result in the participant’s disqualification from the GIVEAWAY. Abusive or fraudulent use will be understood to exist, by way of example and without limitation, when a participant identifies themselves using a false identity or the identities of third parties without their consent.

FRESHLY accepts no responsibility for the use the participant makes of the prize they obtain.

FRESHLY accepts no responsibility for any losses, damage, delays or any other circumstance attributable to third parties that may affect participation in the GIVEAWAY.

FRESHLY reserves the right to change the elements of the prize for others of equal value where there is just cause.

FRESHLY reserves the right to modify or extend these Terms, provided that this does not harm or impair the rights of participants.

The GIVEAWAY may be extended or suspended for justified cause or in cases of force majeure. In any event, FRESHLY will announce this through the same channel through which the GIVEAWAY was announced.

12. Governing law and jurisdiction

These Terms are governed by Spanish law.

To resolve any dispute, disagreement, question or claim arising from the performance or interpretation of these Terms, FRESHLY and the participants submit to the Courts and Tribunals that are competent under the legislation in force on consumers and users.
