FRESHLY COSMETICS, S.L., with registered office at Calle Nicaragua 36, Reus (Postal Code 43204), and Tax ID number B-55666143, organizes this giveaway called “Miluna Open Nature Rooms Experience” (hereinafter, the “Giveaway”), which shall be governed by the following Legal Terms and Conditions (hereinafter, the “Terms and Conditions”).

 

  • Territorial and Time Scope of the Promotion

 

The Giveaway will begin at 10:00 a.m. on November 3, 2025, and will end at 9:00 a.m. on November 9, 2025, both dates included (hereinafter, the “Promotion Period”), on the following webpage: https://www.freshlycosmetics.com/en/lp-giveaway-freshly-x-miluna

 

  • Eligibility Requirements

 

All individuals of legal age residing in Spain or Portugal may participate in the Giveaway.

 Employees of FRESHLY COSMETICS, S.L., as well as employees of any companies involved in the organization of the Giveaway, and their direct relatives up to the second degree of consanguinity or affinity, are not eligible to participate.

If a person who does not meet the requirements set out in these Terms and Conditions is declared the winner, or if the data provided for participation are invalid, their participation will be considered null and void and they will be automatically disqualified.

  • Free Participation

 

Participation in this Promotion is completely free of charge.

 

  • Validity of Participation

To ensure a valid entry in the Giveaway, participants must follow the steps indicated on the Giveaway landing page  https://www.freshlycosmetics.com/es/lp-giveaway-freshly-x-miluna and expressly accept FRESHLY’s data protection and privacy policy.

Participants may also enter through the official social media accounts: instagram.com/freshlycosmetics_es/ instagram.com/freshlycosmetics_pt/

Any fraudulent entries detected will be automatically disqualified from the Giveaway.

Participation implies that the entrant has read, understood, and expressly accepted these Terms and Conditions without reservation.

All non-winning participants agree to receive a thank-you email from FRESHLY, which may include, at FRESHLY’s discretion, a temporary discount code or coupon for participating in the Promotion.

 

  • Prize

 

The prize consists of: 

A 2-night experience at Miluna, an open-air retreat offering panoramic views of the sky, where from sunset to sunrise, guests can unwind in harmony with nature.

Includes:

2 nights in the Deluxe Lunas de Urano Suite with breakfast included for 2 people.

2 dinners at the hotel restaurant.

Private access to the Flotarium + 2-person massage session.

The stay can be enjoyed on any day of the week and is valid for 1 year from the date of issue.Transportation is not included. The prize is subject to Miluna’s availability.

Not included:

Transportation to and from the hotel location. FRESHLY will not cover any travel expenses.

Any additional personal expenses incurred during the stay.

The total prize value is €1,800.

FRESHLY will be responsible for providing the prize in the form of a personalized voucher or coupon, allowing the winner to book directly through the Miluna website.

This voucher will be sent by FRESHLY to the winner once their identity has been confirmed.

Winner Selection

Among all eligible entries received during the Promotion Period, one (1) winner will be randomly selected to receive the prize of two (2) nights at Miluna Open Nature Rooms.

There will be a total of 1 winner.

 

  • Winner Selection

 

On Monday, November 10, 2025, FRESHLY COSMETICS will announce the winner and notify them via email.

The winner will have a period of FIVE (5) calendar days from the date of notification to accept the prize, which must be confirmed by replying to the notification email.

If the winner fails to respond within the indicated timeframe, does not meet the requirements set forth in these Terms and Conditions, or declines the prize, the winner will be disqualified, and the prize will be awarded to the next eligible alternate, following the same selection procedure. There will be a total of 2 alternates.

Considering that the prize consists of products from collaborating brands, FRESHLY reserves the right to update the delivery date of the prize to the winner always with justified reason until all the product lot is ready for delivery to the winner.

 

  1. Intellectual Property and Assignment of Image Rights

By accepting these Legal Terms, participants consent to the use and dissemination of their name and image on the FRESHLY COSMETICS website and social media channels for any promotional activity related to the Promotion, without any right to remuneration or benefit, except for the prize won in accordance with these Legal Terms. 

  1. Data Protection

The personal data required from participants, and, if applicable, from winners, is necessary to manage their participation in the giveaway and, if applicable, to deliver the prize. The personal data of participants or winners required by FRESHLY will be included in a file owned by FRESHLY COSMETICS, S.L., solely to manage this Promotion, communicate and assign the prize, and thank participants. Upon completion of the Promotion, FRESHLY COSMETICS will only retain the data of those participants who have expressly consented to receive newsletters and commercial communications by marking a designated checkbox. The data of other participants will be deleted once the Promotion ends, except for the possibility of retaining them for the exercise and defense of claims, as provided by applicable law.

Participants who have consented to receive newsletters and communications may request to stop such emails as provided in Law 34/2002, of July 11, on Information Society Services, and may revoke their consent unilaterally at any time by sending an email to [email protected] or by unsubscribing directly from the newsletters.

The processing of participants' personal data will comply with the General Data Protection Regulation (EU Regulation 2016/679) and FRESHLY COSMETICS' Privacy Policy. Participants in the Promotion can exercise their rights of access, rectification, cancellation, erasure, portability, opposition, and/or objection to profiling by sending an email to [email protected].   1. Tax Matters
    The prize is subject to the applicable tax regulations on Personal Income Tax, Non-Resident Income Tax, and other tax laws of the winner’s country of residence. Winning a prize of this nature may constitute a capital gain for Personal Income Tax purposes, as it leads to a change in the value of the winner's assets. The winner is solely responsible for fulfilling all tax obligations established by applicable law.
  1. Reservations and Limitations

FRESHLY COSMETICS is not responsible for the malfunction of electronic communication networks that prevent the normal development of the Promotion due to external causes. 

Any abusive or fraudulent use of the participation forms or systems by a participant will result in their disqualification. 

FRESHLY COSMETICS is not responsible for the use of the prize by the participant. 

FRESHLY COSMETICS is not responsible for possible losses, damages, delays, or other circumstances attributable to third parties that could affect participation in the Promotion. 

FRESHLY COSMETICS reserves the right to change the prize elements for others of equal value for justified reasons. 

FRESHLY COSMETICS reserves the right to modify or extend these promotional terms as long as it does not harm the rights of participants. The Promotion may be extended or suspended for justified reasons or in cases of force majeure. 

FRESHLY COSMETICS will communicate any such changes through the same medium as the Promotion.

 

  1. Applicable Law and Jurisdiction

These Legal Terms are governed by Spanish law. To resolve any dispute, discrepancy, question, or claim resulting from the execution or interpretation of these Legal Terms, the Parties expressly submit to the jurisdiction of the Courts and Tribunals of Reus, waiving any other jurisdiction that may correspond to them.
